NOTICE OF PUBLIC HEARING ON PROPOSED RATES AND CHARGES FOR WATER SERVICE Users of the City of Loogootee, Indiana (“City”) water works system, owners of property served or to be served by the City’s water works system, and other interested persons are hereby notified that Ordinance No. 2020-04 (the “Ordinance”) was introduced at a meeting of the Common Council of the City of Lawrenceburg (the “Common Council”) held on July 13, 2020. The Ordinance, if finally adopted, will increase the rates and charges of City’s water works system (as described in the below Ordinance). At a meeting of the Common Council to be held on August 10, 2020, at 5:30 p.m., local time, at the Loogootee Municipal Building, 401 J.F.K. Avenue, Loogootee, Indiana 47553, there will be a public hearing on the matter of such rates and charges, and consideration of final adoption of the Ordinance. At such hearing and prior to final adoption of the Ordinance, all interested persons may appear and be heard. A copy of the Ordinance may be examined in the Office of the City’s Clerk-Treasurer, 401 J.F.K. Avenue, Loogootee, Indiana 47553, during regular office hours. Written comments may be submitted prior to the hearing by submitting them in person during regular business hours at the address noted above or by sending the written comments to: Loogootee Clerk-Treasurer, P.O. Box 276, Loogootee, Indiana 47553. The Ordinance reads as follows: ORDINANCE NO. 2020-04 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF LOOGOOTEE, INDIANA AMENDING THE WATER RATES AND CHARGES FOR LOOGOOTEE, INDIANA WHEREAS, pursuant to Ind. Code §§ 8-1.5 et seq., as amended (the “Act”) the City of Loogootee, Indiana (the “City”) owns, operates, manages and controls a municipal water works system; and WHEREAS, this Common Council of the City of Loogootee, Indiana (“Council”) has previously by ordinance established the existing schedule of user rates and charges for water service; and WHEREAS, pursuant to Ind. Code § 8-1.5-3-8.1, this Council may change or adjust its existing schedule of fees by ordinance after notice and public hearing; and WHEREAS, Ind. Code § 8-1.5-3-8 authorizes this Council to adopt by ordinance a nondiscriminatory, reasonable and just schedule of fees for water services rendered by the City’s water works system; and WHEREAS, Ind. Code § 8-1.5-3-8, authorizes this Council to exercise reasonable discretion in adopting different schedules of fees, or making classifications in schedules of fees, to ensure that the rates and charges produce an income sufficient to maintain the utility property in a sound physical and financial condition to render adequate and efficient service, and whereas rates and charges too low to meet these requirements are deemed unlawful; and WHEREAS, the existing rates and charges for water services rendered by the City will not produce sufficient revenue to pay all the legal and other necessary expenses incident to the operation of the utility, including maintenance costs, operating charges, upkeep, repairs, depreciation, and interest charges on bonds or other obligations; and WHEREAS, because of and based upon such cost increases, it is just, equitable, and reasonable to amend the existing schedules of fees herein for users of the water system; and WHEREAS, this Council finds that the relationship among the rate classifications should be maintained and that the rates should therefore be increased in an across-theboard fashion; and WHEREAS, the Council finds the schedules of fees adopted herein are nondiscriminatory, reasonable and just; and WHEREAS, notice of the public hearing on proposed rates has been given pursuant to the Act; and WHEREAS, a public hearing was held before this Council on August 10, 2020, at which time testimony from interested persons was received, after introduction of this ordinance and pursuant to the Act. NOW, THEREFORE, BE IT ORDAINED by this Common Council of the City of Loogootee, Indiana, that: Section 1. The schedule of user rates and charges attached hereto as Exhibit A, which amends the existing schedule of user rates and charges pursuant to Ordinance No. 200203, adopted by the Council on March 6, 2002, shall apply to users and customers of the water service provided by the City of Loogootee, Indiana. Section 2. The rates and charges provided in this Ordinance shall be effective on and after January 1, 2021.
