TO: Larry Payne a/k/a Larry L. Payne

Plaintiff, by counsel, hereby gives Notice of the Complaint filed in the Martin Circuit Court against the above-named Defendant. Plaintiff also filed an Affidavit of a competent person showing that the residence and whereabouts of Defendant, Larry Payne a/k/a Larry L. Payne upon diligent inquiry are unknown. The cause of action is for default on a promissory note and foreclosure upon a mortgage on the following descried real estate:

The land referred to in this Commitment is described as follows:

A part of the Northeast Quarter of the Northeast Quarter of Section 23, Township 3 North, Range 4 West, Martin Co-unty, Indiana, and described as follows:

Beginning at a nail in the top of a cross-tie fence post which is 254.0 feet North and 389.4 feet East of the Southwest corner of said quarter quarter section; thence North 1 degree 00 minutes West 307.39 feet (passing a P.K. nail in the center of Peeks Road at 162.7 feet) to an iron pipe on the Southerly right of way of U.S. Highway 50; thence along said right of way South 64 degrees 27 minutes 40 seconds East 74.18 feet to an iron pipe which is 150 feet right of Station 1138+50 on said U.S. Highway 50 plans; thence with said right of way and along a curve to the right having a radius of 566.2 for a distance of 197.64 feet, the chord of which bears South 53 degrees 40 minutes East 198.64 feet to a concrete right of way marker which is 150 feet rig-ht of Station 1141+00 on said highway plans; thence with said right of way So-uth 64 degrees 35 minutes 50 seconds East 95.93 feet to an iron pipe which is 110 feet right of Station 1143+03.7 on said highway plans; thence with said right of way and along a curve to the left having a radius of 862.2 feet for a distance of 17.41 feet, the chord of which bears South 38 degrees 59 minutes East, 17.41 feet to an iron pipe; thence leaving said right of way South 50 degrees 25 minutes West 26.0 feet to a P.K. nail in the center of Peeks Road; thence South 89 degrees 00 minutes West 362.00 feet to the beginning.
